These Terms & Conditions ("Terms") govern your use of SkillSwap Ai chat coach ("SkillSwap", "we", "us"), an AI-powered learning service that delivers daily skill-building challenges. By creating an account, accessing, or using the service, you agree to these Terms and form a binding contract with SkillSwap Ai chat coach.

1. Eligibility & Account

You must be of legal age in your jurisdiction (or have a parent / guardian's consent) to use the service. If you use SkillSwap on behalf of an organization, you confirm that you have authority to bind it. You are responsible for the accuracy of information you provide and for keeping your account credentials confidential. All activity under your account is your responsibility.

2. The Service

SkillSwap provides an AI coach that generates personalized skill challenges, tracks your progress (XP, levels, streaks), and chats with you about each skill. The service is provided "as is" and we do not guarantee that it will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose.

3. AI-Generated Content

Coach responses, challenges, and feedback are generated by large language models and may be inaccurate, incomplete, or out of date. You are responsible for verifying any information before relying on it, and for how you use AI-generated outputs.

• Prohibited use: you must not use the service to generate illegal content, malware, hateful or harassing content, sexual content involving minors, defamation, content that infringes intellectual property, or to attempt to jailbreak or circumvent safety controls.
• Your inputs: you must have the right to submit any text, files, or other material you give the coach.
• Not professional advice: outputs are not a substitute for licensed legal, medical, financial, or other regulated professional advice.
• Moderation: we may remove or restrict content, refuse or filter outputs, and suspend accounts that breach these rules. Repeat infringers will be terminated.

4. Acceptable Use

You agree not to:

• use the service for any unlawful purpose, fraud, or spam;
• infringe the intellectual property or privacy rights of others;
• interfere with the security or integrity of the service (including uploading malware, probing, scraping, or attempting unauthorized access);
• resell or redistribute the service, or reverse-engineer it;
• circumvent rate limits or other technical restrictions.

5. Intellectual Property

SkillSwap Ai chat coach owns all rights in the service, including software, design, branding, documentation, and the underlying systems. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with your subscription plan. You retain ownership of content you submit; you grant us a limited license to host and process that content solely to provide the service.

6. Payments, Subscriptions & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Subscriptions renew automatically at the end of each billing period until you cancel. See our Refund Policy for the refund window.

7. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the service at any time. On termination, your right to access the service ends; we may delete account data after a reasonable retention period.

8. Disclaimers

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.

10. Indemnity

You agree to indemnify and hold SkillSwap Ai chat coach harmless from claims arising out of content you submit, your unlawful use of the service, or your breach of these Terms.

11. Changes

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the seller's principal place of business, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction.
